Welcome to SmartAqua (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our water purifier subscription service. By subscribing to our service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
“Service” refers to SmartAqua’s water purifier subscription plan, including installation, maintenance, servicing, and app access provided by the Company.
“Device” refers to the IoT-enabled RO water purifier unit provided by SmartAqua to the Subscriber for use during the subscription period.
“Subscriber” or “you” refers to the individual or entity that has subscribed to the SmartAqua service.
“Subscription Fee” refers to the monthly recurring fee of ₹399 (inclusive of GST) payable by the Subscriber.
“Security Deposit” refers to the one-time refundable amount of ₹2,500 paid by the Subscriber for device activation.
“App” refers to the SmartAqua mobile application available on Android and iOS platforms.
2.1 By subscribing to SmartAqua, you enter into a month-to-month subscription agreement with the Company. There is no minimum lock-in period.
2.2 The subscription commences upon successful installation of the Device at your premises and activation on the SmartAqua App.
2.3 Your subscription includes: unlimited access to purified water, free installation, free filter replacements, free servicing and repairs, and access to the SmartAqua App for monitoring.
2.4 SmartAqua reserves the right to modify the subscription plan terms with 30 days prior written notice to the Subscriber.
2.5 The subscription is non-transferable to another person or location without prior written consent from SmartAqua.
3.1 The Device remains the sole property of SmartAqua at all times. The Subscriber receives the right to use the Device only during the active subscription period.
3.2 A refundable Security Deposit of ₹2,500 is collected at the time of subscription to cover device activation, App access, and to secure against damage or loss of the Device.
3.3 The Security Deposit will be refunded within 7 working days of successful device collection, provided the Device is returned in good working condition with no physical damage beyond normal wear and tear.
3.4 The Subscriber must not attempt to sell, transfer, sub-let, pledge, or in any way encumber the Device.
3.5 Any damage to the Device caused by misuse, tampering, or negligence of the Subscriber may result in partial or full deduction from the Security Deposit.
3.6 If the Device is lost or stolen, the Subscriber must immediately notify SmartAqua and may be liable for replacement costs.
4.1 The Subscription Fee is ₹399 per month, inclusive of all applicable GST. This is the total amount payable — there are no additional charges.
4.2 Subscription fees are billed monthly and must be paid on or before the due date each month.
4.3 Payment can be made via the SmartAqua App using UPI, credit/debit cards, net banking, or other payment methods available on the App.
4.4 In case of non-payment beyond 7 days of the due date, SmartAqua reserves the right to temporarily suspend the service.
4.5 If the subscription remains unpaid for more than 30 days, SmartAqua may terminate the subscription and collect the Device. The Security Deposit will be refunded after deducting any outstanding subscription fees.
4.6 SmartAqua may revise Subscription Fees with 30 days’ advance notice. Continued use of the service after the notice period constitutes acceptance of the revised fee.
5.1 Installation of the Device will be carried out by SmartAqua’s certified technicians at no additional charge, typically within 24–48 hours of subscription activation.
5.2 The Subscriber must ensure reasonable access to the installation location and provide necessary facilities (electricity, water supply connection) for installation.
5.3 SmartAqua will proactively schedule servicing, filter replacements, and maintenance based on IoT monitoring data. The Subscriber will be notified in advance.
5.4 All servicing, repairs, and filter replacements are included in the Subscription Fee at no additional cost, provided the damage is not caused by Subscriber misuse.
5.5 The Subscriber must not attempt to self-service, repair, or tamper with the Device. Unauthorised tampering will void any obligations by SmartAqua and may result in charges.
5.6 SmartAqua will use commercially reasonable efforts to complete service within 48 hours of a reported issue.
6.1 The Subscriber can cancel the subscription at any time without any cancellation fee or penalty, provided at least 7 days’ notice is given.
6.2 Cancellation requests must be submitted through the SmartAqua App or by contacting our support team at support@smartaquapurifiers.com.
6.3 Upon cancellation, SmartAqua will schedule Device collection within 5–7 working days. The Subscriber must ensure the Device is accessible for collection.
6.4 The Security Deposit will be refunded within 7 working days of Device collection, subject to the Device being returned in good condition.
6.5 No pro-rated refund of the current month’s Subscription Fee will be provided upon mid-month cancellation, unless otherwise agreed in writing.
6.6 SmartAqua reserves the right to terminate the subscription with immediate effect in case of Subscriber misuse, damage to the Device, or breach of these Terms.
7.1 If the Subscriber relocates within SmartAqua’s service areas, the subscription can be continued at the new address. The Subscriber must notify SmartAqua at least 7 days before the relocation date.
7.2 SmartAqua will arrange Device reinstallation at the new address. A one-time reinstallation fee may apply for relocations beyond a certain distance, which will be communicated to the Subscriber in advance.
7.3 If the new address is outside SmartAqua’s service area, the Subscriber may cancel the subscription without penalty, and the Security Deposit will be refunded in full upon Device collection.
8.1 The Subscriber must use the Device only for its intended purpose — purification of water for drinking and cooking.
8.2 The Subscriber must not tamper with, modify, or attempt to repair the Device.
8.3 The Subscriber must provide SmartAqua technicians reasonable access to the Device for servicing and maintenance.
8.4 The Subscriber must promptly notify SmartAqua of any Device malfunction, damage, or unusual behaviour via the App or helpline.
8.5 The Subscriber is responsible for maintaining the area around the Device in a clean and accessible condition.
8.6 The Subscriber must not allow unauthorised third parties to service or tamper with the Device.
9.1 SmartAqua’s liability to the Subscriber in any circumstance is limited to the total Subscription Fees paid in the 3 months preceding the event giving rise to the claim.
9.2 SmartAqua shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the service.
9.3 SmartAqua is not responsible for damage caused by force majeure events including natural disasters, government actions, or any other circumstances beyond our reasonable control.
9.4 The quality of water purified by the Device is dependent on the quality of the input water supply. SmartAqua warrants that the Device will operate as per its specifications under normal Indian water supply conditions.
10.1 SmartAqua collects and processes Subscriber data (including usage data from the IoT Device) in accordance with our Privacy Policy.
10.2 Usage data collected by the Device (water consumption, quality metrics, filter health) is used solely to provide and improve the service.
10.3 SmartAqua will not sell or share Subscriber personal data with third parties without explicit consent, except as required by law.
10.4 By subscribing, you consent to SmartAqua sending service-related notifications via SMS, email, and push notifications through the App.
11.1 In the event of any dispute, the Subscriber should first contact SmartAqua’s customer support to seek an amicable resolution.
11.2 If the dispute cannot be resolved within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
11.3 The arbitration shall be conducted in Pune, Maharashtra, India, and the language of arbitration shall be English.
12.1 These Terms shall be governed by and construed in accordance with the laws of India.
12.2 The courts in Pune, Maharashtra shall have exclusive jurisdiction over any disputes arising from these Terms.
